VISAS AND IMMIGRATION How to choose a guardian for your child studying abroad

Most UK boarding schools, including Earlscliffe, require international students under 18 to have a nominated UK guardian in place before they start. From May 2025, updated UKVI rules have strengthened guardianship requirements for Child Student visa holders — making the choice of guardian more important than ever.

New from May 2025: UKVI now requires that nominated guardians must be UK-based adults with British citizenship or settled status, available all hours, and confirmed in writing via a signed Letter of Undertaking. Schools must keep documentation on file.

What does a UK guardian actually do?

A guardian’s role covers everything excluded from the school’s direct responsibilities. In practice, this means:

• Holiday accommodation
  Arranging safe, vetted homestay accommodation for your child during school holidays and half terms — either with approved host families or at a residential programme, depending on your preferences.
• 24/7 emergency cover
  Being reachable day and night for any emergency — a medical issue, a cancelled flight, an urgent situation at school, or anything else that requires an available adult in the UK. Guardians should live within a 2-hour journey from the school.
• School liaison
  Acting as a direct point of contact between Earlscliffe and your family — attending parents’ evenings and school meetings on your behalf, passing on important information and advocating for your child when needed.
• Acting in loco parentis
  Taking on parental responsibility for medical decisions, signing consent forms, and making welfare judgments whenever you cannot be reached or cannot be present in person.
• Travel logistics
  Ad-hoc airport transfers, meeting students at airports if flights are delayed, and making sure every transition between school, accommodation and home runs smoothly.
• Wellbeing & welfare
  Regular welfare check-ins, keeping parents updated on how their child is settling in, and providing culturally sensitive pastoral support — especially important in the first weeks of a new school year.

Quality assurance – Understanding AEGIS accreditation

AEGIS — the Association for the Education and Guardianship of International Students — is the independent body that accredits and inspects guardianship organisations across the UK. It is the closest thing the sector has to a regulatory standard, and it was founded in 1994 by a group of boarding schools and guardianship organisations to promote universal high standards of care.

AEGIS inspects accredited organisations every four years against 11 quality areas, including safeguarding policies, staff training, host family vetting, emergency procedures, communication with parents and compliance with the National Minimum Standards for Boarding. Accreditation is awarded at three levels: Gold, Silver and Bronze.

The Boarding Schools’ Association (BSA) also maintains a list of approved guardianship agencies at boarding.org.uk. Earlscliffe’s admissions team can also suggest local organisations with experience supporting students at our school.

Regulatory update – New UKVI guardianship rules: what changed in May 2025

From 29 May 2025, UK Visas and Immigration (UKVI) introduced tighter rules around guardianship for Child Student visa holders. These changes strengthen child protection for international students and affect both how guardians are appointed and how schools document those arrangements. Here is what the new rules require:

• UK residency & status – Nominated guardians must be UK-based adults with British citizenship or settled status. Previous arrangements involving non-settled individuals may no longer satisfy the Home Office requirements.
• Age requirement – Guardians must be aged 18 or over. UKVI guidance recommends 21 or over for added confidence that the guardian can fulfil the role reliably and independently.
• 24/7 availability – The nominated guardian must be reachable at any time of day or night as an emergency contact. Schools are now expected to reduce reliance on themselves as the primary emergency contact during holidays.
• Letter of Undertaking – A signed Letter of Undertaking confirming the guardian’s commitment to fulfil the role must be in place. Professional organisations issue these as standard; private guardians will need to sign one.
• Clear care arrangements – The Child Student visa application must clearly state how and where the child will be cared for during school holidays. Vague or unconfirmed arrangements may now result in visa delays or refusals.
• School documentation – As a licensed Student Sponsor, Earlscliffe must hold documentation confirming that appropriate guardianship is in place, including proof of AEGIS accreditation where a professional organisation has been appointed.
